Terms of Service

1. Agreement

By creating an account or using TenantTracer ("the Service"), you ("you", "user") agree to these Terms. If you do not agree, do not use the Service.

2. The Service

TenantTracer helps commercial real estate professionals identify prospective tenants for their listings, including surfacing business contact information sourced from licensed third-party data providers, and tools to organize outreach.

3. Subscription & billing

Paid plans are billed in advance on a recurring basis at the rate shown at checkout. Subscriptions renew automatically until cancelled. You can cancel at any time; cancellation takes effect at the end of the current billing period.

4. Acceptable use of data

The Service provides access to business-contact data from licensed third-party providers. You agree to the following restrictions, which apply to all data you access through the Service:

• No resale or redistribution. You may not resell, sublicense, distribute, or otherwise provide access to the data, or information derived from it, to any third party, or use it outside the scope of your own legitimate business use within the Service.
• No competing database. You may not use the data to build, train, or populate a product or database that resembles or competes with the underlying data provider, and may not extract a material or substantial portion of the data.
• No bulk extraction. You may not scrape, bulk-export, or programmatically harvest data from the Service.
• Lawful outreach only. Any outreach you conduct using contact information must comply with all applicable laws, including CAN-SPAM, CASL, GDPR, and CCPA, and must honor opt-out requests.

These restrictions are required by our data providers and flow down to you as a condition of using the Service. Violation may result in immediate termination.

5. Your responsibilities

You are responsible for activity under your account, for keeping your credentials secure, and for ensuring your use of contact data complies with applicable privacy and anti-spam laws.

6. Termination

We may suspend or terminate your access for breach of these Terms, including misuse of data. On termination, your license to use data obtained through the Service ends and you must cease using and delete any such data in your possession.

7. Disclaimers

The Service and all data are provided "as is" without warranties of any kind. Contact data may be incomplete or inaccurate; you are responsible for verifying information before relying on it for outreach.

8. Limitation of liability

To the maximum extent permitted by law, TenantTracer is not liable for indirect, incidental, or consequential damages arising from your use of the Service.
